Terms of Service

These Terms of Service are valid from 1st of January 2025.

This FusionProxy Terms of Service agreement (the “Agreement“) governs the contractual relationship between Fusion Proxy as a service provider (“Company”, “we”, “us”) and any natural or legal person as a service user (“Client”, “you”).

1. General provisions and definitions

1. Fusion Proxy is a legal entity incorporated. The Company is acting as the main service provider under the Agreement.
   1. The Company may contract other persons (e.g., group companies, third-party service providers) to ensure proper provision of the Services to its clients. In such cases the Company remains the main service provider.
2. Any person using Company’s services/systems is considered to be a client under this Agreement. The Client can be a natural person or a legal person represented by a natural person.
   1. Services are offered only to natural persons of legal age. You are responsible for ensuring you are eligible to use the Services.
   2. Services are offered only to duly established legal entities. Representatives are responsible for having proper authorization.
3. The Company provides multiple IP address proxy infrastructure solutions, including IP addresses for Clients to connect to the internet, and access to the Company’s data gathering and proxy management solutions (the “Services”). The Services can be reached and used via website www.fusionproxy.net (the “System”).
   1. Full list of the Services is indicated in the System.
   2. The Company may change the list of Services from time to time, without prior notice.
   3. The Client is entitled to use the specific Service paid for, only for the paid period.
   4. Services and System are available globally with possible restrictions due to regulation. The Client must ensure it is legal to access the System / use the Services in the Client’s location.
4. Services are available under subscription and pay-as-you-go models. Subscriptions renew automatically until cancelled as per Subscription Terms. Pay-as-you-go is billed for the specific amount of Service used, without auto-renewal.
5. By creating an account and/or ordering/using the Services you agree to this Agreement and other rules governing the Services/System.
6. This Agreement takes effect when you sign up by creating an account (see Clause 2). Its rules apply mutatis mutandis to any System use prior to/without signing up, including Privacy Policy, Subscription Terms and Acceptable Use Policy.

8. The Company may unilaterally modify/update the Agreement at any time without notice. Continued use means acceptance of the latest version, available at https://fusionproxy.net/#/terms.
9. By agreeing to this Agreement, you acknowledge the Company may process your personal data where necessary to perform the Agreement. By creating an account, you consent to personal data processing for direct marketing and advertising purposes (you may withdraw later).
10. If you disagree with any terms, you must not use or must cease using the System/Services.

2. Creating an account

1. To use the Services, register via https://dashboard.fusionproxy.net/#/register. Once all steps are fulfilled, you will be able to use your user account (the “Account”).
2. Upon using the System, the Client shall allow cookie use by customizing preferences or allowing all cookies. See Privacy Policy (cookies section) at https://fusionproxy.net/#/privacy.
3. Required registration data may include: personal info / representative info, company name (if applicable), valid email, phone number, country of residence, password, service requirements, confirmations of Agreement and Privacy Policy acceptance, and a confirmation that the Client / representative is a natural person.
4. Acceptance of Agreement, Privacy Policy and other rules is mandatory. Identity/phone verification may be required per Privacy Policy.
5. CAPTCHA or similar human-verification tests may be required.
6. Email verification via link is mandatory.
7. The Company may change required information at any time.
8. Payment details must be provided to conclude an order.
9. The Company may ask you to re-submit/renew data periodically or ad-hoc.
10. By creating the Account, the Client declares provided information is true, complete, valid, up-to-date and legitimately used.
    1. By creating an Account, you consent to receive direct marketing and advertising materials (you may unsubscribe at any time).
    2. If you do not consent, either do not complete registration or unsubscribe via the link in our emails after registration.
11. Accounts can be personal or business. Do not share credentials. The Account is strictly for own use and not on behalf of others.
12. We recommend enabling two-factor authentication (2FA).

3. Suspension of Services and Account access

1. If the Account holder does not match the owner or discrepancies exist, the Company may suspend Services and/or remove account access.
2. Additional grounds for suspension/denial include: material breach (e.g., non-payment), lack of legal age/authorization, restricted location access, Acceptable Use Policy or Subscription Terms violations, Referral program violations, security/reputational/financial risks, or breach of law/good morals.
3. Client will be notified by email with reason and term of suspension and steps (if any) to remedy.
4. Remedy periods (if any) are at Company’s discretion.
5. Suspected legal violations may be reported to law enforcement. Lifetime bans may apply where appropriate.

4. License to access and use the System

1. Subject to this Agreement, the Company grants you a non-exclusive, limited, non-transferable and revocable license to use Company materials solely in connection with your use of the System and Services.
2. The Service is intended for research, personal and your own legitimate commercial use, and only for lawful purposes.
3. The license terminates upon cessation of use or termination of the Agreement.
4. The Company may cease supporting the System/parts/features at any time; the license is then suspended.
5. Unless otherwise stated, the Company owns all IP in the System and its materials. You must not infringe such rights.
6. Prohibited actions include: republishing, selling, renting, sublicensing, public display, reproduction, redistribution, editing, damaging/impairing the System, etc., unless explicitly allowed.
7. The Agreement applies to all versions, features and derivatives of the System.

5. Risks

1. You acknowledge inherent risks: software/IT weaknesses, regulatory risk, theft/Internet vulnerabilities, tax risk.
2. Beware of phishing/spoofing. Always access your account via https://www.fusionproxy.net or the dashboard and contact [email protected] if in doubt. The Company is not responsible for losses due to such attacks.

6. Payments and refunds

1. Services are available as subscription and pay-as-you-go. Subscription Services are also subject to Subscription Terms.
2. Payment/refund rules for subscriptions: see Subscription Terms.
3. The Company may determine prices, validity, promotions and discounts at its discretion.
4. Up-to-date prices are available on the System and dashboard.
5. Payment models, prices and scopes may change without notice; check before ordering.
6. Free-trial access expires unless paid for further use.
7. Card-on-file trial verification: when a free trial is started with a card on file, the Company charges $1.00 USD and refunds it in the same request to verify that the card is active and has available funds. Both the charge and the matching refund appear on the cardholder's statement; the net amount retained by the Company is zero. Bank settlement timing for the refund may take up to 10 business days, depending on the issuer.
8. Trial auto-upgrade and refund window: unless the trial is cancelled before it ends, the card on file is charged the then-current subscription price on the final trial day and the paid plan activates. If the cardholder has used less than 1 GB of the plan's bandwidth at the time of the request, the upgrade charge may be refunded in full via the in-dashboard self-serve refund within 7 days of the charge. After that window or after more than 1 GB of use, refunds are at the Company's discretion.
9. “User balance” may be used to cover payments. Deposit/withdrawal options and limitations are shown in the dashboard’s “Deposit/Withdrawals” section — review them before depositing.
10. Actual fees, methods, billing periods/frequency are shown and confirmed at order time.
11. All paid fees are non-cancelable and non-refundable except: (i) service is inactive/defective within first 24 hours due to Company reasons and not promptly fixed; (ii) cases in Subscription Terms; (iii) exceptional goodwill refunds at Company discretion.
12. Fees are net of taxes; you are responsible for applicable taxes/duties.
13. You warrant lawful use of payment methods and keeping payment info up-to-date.
14. Claims about fees/charges must be submitted within 3 months of charge date.

7. Referral program and reselling

1. The Company may offer a Referral program — main info in the System dashboard and on the site.
2. By participating you act as a referrer promoting the Company to attract new users.
3. You can use referral links/banners/materials provided in your account (subject to rules and law/good morals).
4. Prohibited behaviors include fraud, bidding on Company trademarks, spamming, impersonation, deceptive practices, involving children, dark patterns, fake reviews, pyramid schemes, etc.
5. Rewards/commissions, thresholds and limits (e.g., per-user caps) may be set/changed by the Company. Always check current rules.
6. Cookies/attribution windows and registration windows apply for commission eligibility; deletion/rejection of cookies may void eligibility.
7. Withdraw rewards via tools in the “Withdrawals” section (minimums/limits/currencies apply). Violations may forfeit rewards.
8. Reselling (if offered) is separate from Referral program and follows distinct rules/pricing disclosed by the Company.

8. Third-party and other disclaimers

1. The Company may use third parties (payments, registration, etc.). Client data may be disclosed to such providers per Privacy Policy.
2. Use of third-party services is subject to their own terms; disputes are between Client and the third party.
3. Links to third-party sites are for convenience; we do not endorse nor warrant their content.
4. Information on the System (including blog) may contain inaccuracies; verify before making decisions if in doubt.

9. Indemnification

1. Client agrees to defend, indemnify, and hold harmless the Company and affiliates against third-party claims arising from: (i) Client’s breach of representations/warranties; (ii) Client’s failure to comply with applicable laws, except where caused by Company’s breach.
2. Suggestions/feedback are voluntary and may be used by the Company without obligation; a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license applies for incorporating feedback into the Services/System.
3. The System and Services are provided “as is”, at your own risk. No warranties beyond those expressly set herein.
4. You are responsible for meeting technical requirements (hardware/software/network). The Company has no obligation to ensure compatibility.

10. Termination

1. The Company may suspend/terminate Accounts per this Agreement (notably sections 3, 6, 10 and Subscription Terms). Breaches may result in no refunds/rewards.
2. Either party may terminate by deleting the Account. Breach-based terminations forfeit refunds/rewards.
3. Upon termination, your right to use Services ceases immediately; outstanding fees remain payable.
4. Material breaches may be reported to authorities; lifetime bans may apply, including blocking identifiers (name, IP, email).
5. To delete your Account: open Settings → Delete account. Withdraw/use User Balance funds beforehand (crypto withdrawals may be unavailable after deletion; unused services are non-refundable).

11. Governing Law and sanctions

1. The laws of United Arab Emirates govern this Agreement and your use of the Services.
2. Disputes: first try to resolve informally via [email protected].
3. The Company prohibits illicit use (e.g., money laundering, terrorist financing, sanctions violations) and complies with applicable regimes.
4. The Company may block access in certain jurisdictions/territories and restrict prohibited locations/residents.
5. You represent you are not on any prohibited/sanctioned/restricted party list. If that changes, cease use immediately.

12. Miscellaneous

1. English is the governing language. Other languages may be used for convenience only. The English version prevails.
2. Updates take effect when published on the System (see Clause 1). Continued use = acceptance.

4. The Company endeavors to reply to inquiries within 30 days (with two possible 30-day extensions).
